01About these Terms
1.1These Terms & Conditions (the “Terms”) are a legally binding agreement between you and [LEGAL ENTITY NAME], [COMPANY NUMBER], of [REGISTERED ADDRESS] (“ArchStudio”, “we”, “us” or “our”). They govern your access to and use of the ArchStudio website, the ArchStudio 3D home design studio, and any related features, content and support (together, the “Service”).
1.2By creating an account, signing in, starting a trial, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
1.3If you use the Service on behalf of a business or other organisation, you agree to these Terms for that organisation and you confirm you have authority to bind it. In that case “you” includes the organisation.
1.4These Terms include the pricing and plan descriptions shown on our pricing page at the time of your purchase, which form part of your contract. If there is a conflict, these Terms prevail over the pricing page except for the price, plan limits and billing period you actually purchased, which prevail over these Terms.

03Eligibility and your Account
3.1You must be at least 16 years old, or the age of digital consent in your country if higher, and able to form a binding contract. The Service is not intended for children. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3.2You sign in using Google Sign-In. You are responsible for the security of your Google account and for all activity that takes place through your Account. You must tell us promptly at [CONTACT EMAIL] if you suspect unauthorised use.
3.3You must provide accurate information, including a valid billing name and, where applicable, a tax identification number, and keep it up to date through the account settings page.
3.4Each Seat is for one named person. You may not share a Seat, or log in as another person, and you may reassign a Seat only when the original user no longer needs access.
3.5You may have only one free Explore Account per person. We may close duplicate accounts created to avoid limits, repeat Trials or pricing.
3.6You are responsible for the acts and omissions of every person you invite to your Workspace as if they were your own.
04The Service
4.1We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your own lawful purposes, subject to these Terms and the features of your Plan.
4.2The Service is delivered through your web browser. You are responsible for your own device, browser, internet connection and any fees charged by your provider. A modern browser with WebGL support is required.
4.3We continually develop the Service. We may add, change, limit or retire features, Gallery Content or Plans. If we make a change that materially reduces the core functionality of a paid Plan during a billing period you have already paid for, we will give you reasonable notice and, if you ask within 30 days, a pro-rata refund for the unused part of that period.
4.4Some features may be labelled “preview”, “beta” or “demo”. They are provided for evaluation, may be incomplete or change without notice, and are excluded from any service commitment. In a preview build, certain account data is stored only in your browser, as described in the Privacy Policy.
4.5We aim to keep the Service available but do not promise uninterrupted or error-free operation. We may suspend access for maintenance, security or reasons outside our control.
4.6Support is provided by email. Studio Plan customers receive priority support. We do not promise a specific response time unless we agree one in writing.
05Plans, features and entitlements
5.1The features included in each Plan are listed on the pricing page. At the date of these Terms, Explore includes the gallery homes (apartment buildings included, to view), walk mode, cutaway, lighting and sun study, live estimates, share links and watermarked exports, and up to three saved projects. Pro adds build mode, buildings of up to ten storeys (Explore builds up to three), edit in place for gallery homes, 4K snapshots, unlimited saved projects, GLB and SVG export, exports without watermark, the full specification sheet and commercial use. Studio adds client presentation mode, your logo on exports, seat management and roles, consolidated invoicing and priority support, with a minimum of two and a maximum of fifty Seats.
5.2Your entitlement to a paid Plan is determined by our records and by confirmation of payment from our Payment Provider. You must not attempt to unlock features by editing data in your browser, replaying or forging payment confirmations, or otherwise bypassing technical limits.
5.3We may change the features or limits of a Plan for future billing periods. Changes that are adverse to you take effect at your next renewal, and we will notify you at least 30 days beforehand.
06Free Trials
6.1We may offer a free Trial of Pro or Studio for 14 days. A Trial is available once per Plan for each person or organisation. We may refuse or end a Trial if we reasonably suspect abuse.
Trials need no card. You are not charged at the start of a Trial. You choose at checkout whether the Plan should continue when the Trial ends. If you choose to keep the Plan, your payment method is charged on the day the Trial ends and the subscription starts, and it then renews automatically under section 7. If you do not, the Trial ends without charge and your Account returns to Explore.
6.2You may end a Trial at any time from your subscription page. Projects you created during a Trial remain available after it ends. If you have more projects than the Explore limit, you can still open and export them under the Explore Plan, but you cannot save new projects until you are within the limit.
07Fees, billing and payment
7.1Prices are shown on the pricing page in US dollars, euros, pounds sterling or Australian dollars. The price that applies to you is the price displayed at checkout. Unless stated otherwise, prices exclude applicable sales tax, VAT, GST and similar taxes, which are added at checkout where required.
7.2Payments are processed by our Payment Provider. By subscribing you authorise us and the Payment Provider to charge your chosen payment method for the fees, taxes and any other amounts due. Where the Payment Provider’s Managed Payments service applies to your purchase, the Payment Provider may act as the merchant of record and collect and remit taxes, and its own terms apply to that sale. We do not store your full card number.
Automatic renewal. Subscriptions renew automatically at the end of each monthly or yearly billing period for the same period, at the then-current price, until you cancel. You authorise recurring charges until you cancel. You can cancel at any time under section 8 and the cancellation takes effect at the end of the period you have paid for.
7.3Studio is priced per Seat per month, billed in advance for the number of Seats you select. If you add Seats during a billing period, we charge the pro-rata price for the remainder of that period. If you remove Seats, the reduction applies from your next renewal and no credit is given for the current period.
7.4When you upgrade to a more expensive Plan, the change applies immediately and we charge the pro-rata difference. Downgrades and changes to the billing period take effect at your next renewal.
7.5If a payment fails, we or the Payment Provider may retry it. If the amount remains unpaid after reasonable attempts and notice, we may suspend your paid features or move your Account to Explore. You remain liable for amounts already due.
7.6We may change our prices at any time. Changes apply from your next renewal and we will notify you at least 30 days before they take effect. If you do not agree to a price change, you may cancel before it applies.
7.7Invoices and receipts are available from the account settings page and are emailed to your Account address. You are responsible for providing correct billing details, which appear on your invoices.
7.8If you believe a charge is wrong, please contact us at [CONTACT EMAIL] within 60 days so that we can investigate. Raising a chargeback without first contacting us may delay resolution and may result in suspension of your Account.
08Cancellation, changes and refunds
8.1You can cancel your Subscription at any time from your subscription page or the billing portal. After you cancel, you keep your paid features until the end of the billing period you have already paid for, and your Account then moves to Explore. We do not charge cancellation fees.
8.2Except where these Terms or applicable law say otherwise, fees are non-refundable, including for partly used billing periods and unused Seats.
Your statutory rights. Nothing in these Terms limits any rights that you have under mandatory consumer law. For example, if you are a consumer in the European Union or the United Kingdom you may have a right to cancel a distance contract within 14 days. By starting to use a paid Plan immediately you ask us to begin performing the Service during that period; if you then cancel within the 14 days you must pay a proportionate amount for what you have used, and your right to cancel ends once the Service has been fully performed. Consumers in Australia have rights under the Australian Consumer Law, including remedies for major failures, which cannot be excluded.
8.3We will refund fees where required by law, in the circumstances described in section 4.3, and where we agree to it in writing, for example if we charged you in error. Refunds are made to the original payment method and may take several days to appear.
09Your Content
9.1As between you and us, you own your Content. We do not claim ownership of it.
9.2You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display and transmit your Content solely as needed to operate, secure and support the Service for you, including to show it to people you choose to share it with. This licence ends when you delete the Content or your Account, except for copies in routine backups for the limited period described in the Privacy Policy.
9.3You are responsible for your Content and for having all rights needed to use it, including any images, logos or plans you upload. You must not upload Content that infringes the rights of others, is unlawful, or breaches section 11.
9.4If you create a share link, anyone who has the link can view the shared design. You are responsible for who you give the link to.
9.5In the current version of the Service, saved projects are stored in your browser on your device and are not backed up or synced by us. You are responsible for exporting and keeping copies of anything important. Clearing your browser data, using a different device or deleting your Account removes projects that are stored only on your device.
9.6We may remove or disable Content that we reasonably believe breaches these Terms or the law, and we will tell you where we reasonably can.
10Our intellectual property
10.1The Service, including its software, user interface, design, procedural geometry engine, text, graphics, the ArchStudio name and logo, and all Gallery Content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
10.2Subject to your Plan, you may use Gallery Content as it appears in designs and exports you create using the Service, including for commercial projects on a Pro or Studio Plan. You may not extract, scrape, redistribute, sell or sublicense Gallery Content on its own, or use it to build a competing library or product.
10.3You must not copy, modify, decompile, reverse engineer or attempt to derive the source code of the Service, except to the extent that applicable law permits it despite this restriction, or build a product or service that competes with the Service by using it.
10.4If you send us ideas, suggestions or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free licence to use them without obligation to you.
10.5Open-source and third-party components are licensed under their own terms. Notices are available on request at [CONTACT EMAIL].
11Acceptable use
11.1You must use the Service lawfully and responsibly. You must not, and must not allow anyone else to:
- use the Service to infringe, misappropriate or violate any intellectual property, privacy or other rights, or any law or regulation;
- upload or share Content that is unlawful, defamatory, hateful, sexually exploitative, or that promotes violence or harm;
- attempt to gain unauthorised access to the Service, other accounts, or our systems or networks;
- introduce malware, or interfere with, disrupt or place an unreasonable load on the Service, including by automated means such as scraping, crawling or bulk requests;
- probe, scan or test the vulnerability of the Service without our written permission, other than under section 16;
- circumvent or tamper with Plan limits, entitlements, watermarks, billing checks or security features;
- resell, sublicense, rent or make the Service available to third parties except as the Studio Plan permits for your own team;
- use the Service to develop weapons or for any activity that is prohibited under applicable sanctions or export-control laws; or
- impersonate any person or misrepresent your affiliation.
11.2We may investigate suspected breaches and take action that we consider appropriate, including removing Content, suspending or closing Accounts and cooperating with law enforcement.
12Exports and commercial use
12.1Exports from the Explore Plan carry a watermark and may be used for personal, non-commercial purposes only. Exports without a watermark and commercial use are available on Pro and Studio.
12.2You own the designs and exports you create using your Content. Exports may contain Gallery Content and third-party material, which you may use as part of your design under section 10.2 and the licence terms of the relevant provider, but not as a standalone asset library.
12.3Studio Plan customers may add their own logo to specification sheets and exports. You confirm you have the right to use any logo you upload.
13Estimates, outputs and professional advice
Important. ArchStudio is a design and visualisation tool. It is not a substitute for the services of a licensed architect, engineer, surveyor, quantity surveyor or other professional.
13.1Estimates, areas, costs, energy and sun figures, specification sheets, plans, elevations and models are indicative and intended for early-stage design. They are based on simplified assumptions, generic rates and currency conversions that may differ from actual prices, local building codes or site conditions.
13.2Outputs are not construction documents and must not be used to obtain permits, tender, build or purchase without independent verification by a suitably qualified professional. You are solely responsible for deciding whether and how to use any output and for compliance with applicable laws, codes and standards.
13.3We do not guarantee that outputs are accurate, complete or suitable for any particular purpose.
14Third-party services and materials
14.1The Service works with third-party services, including Google (sign-in), Stripe (payments, invoices and the billing portal), a hosting and infrastructure provider, and providers of textures and sky environments such as Poly Haven. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.
14.2The Service may link to third-party websites. We do not control and are not responsible for their content or practices.
14.3Some features rely on open-source software, including the three.js graphics library. Those components are licensed under their own open-source licences.
15Privacy and data protection
15.1We process personal information as described in our Privacy Policy, which forms part of these Terms. You can view, export and delete your information from the account settings page.
15.2If you add team members, client details or other individuals’ personal information to a Studio Workspace, you are responsible for having a lawful basis to do so and for giving any required notices. In that case, to the extent we process that information on your behalf we act as your processor and will process it only on your documented instructions. A data processing addendum is available on request at [CONTACT EMAIL].
16Security and responsible disclosure
16.1We use reasonable technical and organisational measures to protect the Service, as described in the Privacy Policy. You are responsible for protecting your device and Google account.
16.2If you believe you have found a security vulnerability in the Service, please report it to [SECURITY CONTACT EMAIL] with enough detail to reproduce it. Please give us a reasonable time to fix the issue before disclosing it, and do not access other people’s data, degrade the Service or run denial-of-service tests. We will not take legal action against good-faith research that follows these rules.
17Suspension and termination
17.1You may stop using the Service and delete your Account at any time from the account settings page. If you have an active Subscription, cancel it first under section 8, because deleting an Account does not by itself stop billing by our Payment Provider.
17.2We may suspend or terminate your access, with notice where practical, if: you materially or repeatedly breach these Terms; you do not pay amounts when due; we are required to by law; your use creates a security risk or legal exposure for us or others; or we stop providing the Service (in which case we will refund prepaid fees for the period after termination).
17.3On termination your right to use the Service ends. You will have a reasonable opportunity, which we expect to be at least 30 days where we terminate for convenience, to export your Content where we hold it for you.
17.4Sections that by their nature should continue, including sections 9, 10, 18 to 20, 21 and 24 to 25, survive termination, as do accrued rights to payment.
18Disclaimers
18.1The Service and all Gallery Content are provided “as is” and “as available”. To the fullest extent permitted by law, we and our licensors disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free or that defects will be corrected.
18.2We do not warrant the accuracy of Estimates or outputs, or that the Service will work with every device or browser.
18.3Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply to the maximum extent permitted by law. Nothing in these Terms excludes any guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law.
19Limitation of liability
19.1Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited by law.
19.2Subject to section 19.1, to the fullest extent permitted by law we will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of profit, revenue, business, goodwill, anticipated savings, or loss or corruption of data, arising out of or in connection with the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were advised of the possibility.
19.3Subject to section 19.1, our total aggregate liability arising out of or in connection with the Service and these Terms in any twelve-month period is limited to the greater of (a) the fees you paid us for the Service in the twelve months immediately before the event giving rise to the claim and (b) USD 100.
19.4We are not liable for any loss arising from your reliance on Estimates or outputs, from decisions made about construction, purchasing or compliance, or from Content stored only in your browser being lost.
19.5If you are a consumer, these limitations apply only to the extent permitted by the mandatory laws of the place where you live. Where the Australian Consumer Law applies and we are permitted to limit our liability for breach of a non-excludable guarantee, our liability is limited, at our option, to resupplying the services or paying the cost of having them resupplied.
20Indemnity (business users)
20.1If you use the Service for business purposes, you agree to defend, indemnify and hold harmless us and our officers, employees and contractors from claims, losses, liabilities and reasonable costs (including legal fees) arising from your Content, your breach of these Terms or the law, or your infringement of any third party’s rights. This section does not apply to consumers.
21Copyright complaints
21.1We respect intellectual property rights. If you believe Content on the Service infringes your copyright, send a notice to [DESIGNATED AGENT EMAIL] that identifies the work, identifies the infringing material and where it is located, gives your contact details, states that you have a good-faith belief that the use is not authorised and that your notice is accurate, and is signed by you or your authorised agent.
21.2We may remove or disable access to the material, notify the person who provided it and, in appropriate circumstances, close the Accounts of repeat infringers. A counter-notice may be sent to the same address.
22Changes to these Terms
22.1We may update these Terms from time to time, for example to reflect changes to the Service, the law or our practices. We will post the updated Terms with a new effective date and, for material changes, notify you by email or in the Service at least 30 days before they take effect, unless the change is required sooner by law.
22.2If you continue to use the Service after the changes take effect, you accept them. If you do not agree, you must stop using the Service and cancel your Subscription before the changes apply.
23Notices and electronic communications
23.1We may give notice to you by email to your Account address, by a notice in the Service, or by posting on our website. You are responsible for keeping your email address current. You consent to receive notices electronically, and electronic notices satisfy any legal requirement that notices be in writing.
23.2You may give notice to us at [CONTACT EMAIL] or [POSTAL ADDRESS]. Notices are effective when received.
24Governing law and disputes
24.1These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by the laws of [GOVERNING LAW JURISDICTION], without regard to its conflict-of-laws rules.
24.2Before starting formal proceedings, each party will try in good faith to resolve a dispute informally. Please contact us at [CONTACT EMAIL] and we will try to resolve it within 30 days.
24.3Subject to section 24.4, the courts of [COURT JURISDICTION] have exclusive jurisdiction to settle any dispute that is not resolved informally, and each party submits to that jurisdiction.
24.4If you are a consumer, you will also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country. If you live in the European Union you may also use the European Commission’s online dispute resolution platform where it is available.
25General
Entire agreement. These Terms, the Privacy Policy and the pricing information you purchased constitute the entire agreement between you and us about the Service and replace all earlier agreements and understandings about it.
Severability. If a provision is found to be unlawful or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in full force.
No waiver. A failure or delay in exercising a right is not a waiver of that right.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, such as natural disasters, war, labour disputes, power or internet failures, or failures of third-party providers.
Third-party rights. No one other than you and us has any right to enforce these Terms, except that our licensors may enforce section 10.
Interpretation. Headings are for convenience only. “Including” means “including without limitation”. These Terms are written in English, and any translation is for convenience only.
Export and sanctions. You must not use or export the Service in violation of applicable export-control or sanctions laws.
